北京市房屋租賃合同
一、本合同為北京市國(guó)土資源和房屋管理局與北京市工商行政管理局共同制訂的示范文本，供房屋租賃雙方當(dāng)事人約定使用，但不適用于執(zhí)行政府規(guī)定租金標(biāo)準(zhǔn)的公有房屋的租賃關(guān)系。簽訂合同前，雙方當(dāng)事人應(yīng)仔細(xì)閱讀合同各項(xiàng)條款，未盡事宜可在第十八條“其他約定事項(xiàng)”或合同附件中予以明確。二、簽訂合同前，租賃雙方應(yīng)相互交驗(yàn)有關(guān)身份證明及房屋權(quán)屬證明。三、接受他人委托代理出租房屋的，應(yīng)在簽訂本合同前出示委托人開(kāi)具的授權(quán)委托書(shū)或出租代理合同，向承租方明示代理權(quán)限。四、租賃雙方應(yīng)共同查驗(yàn)房屋內(nèi)的設(shè)施、設(shè)備，填寫(xiě)《房屋附屬設(shè)施、設(shè)備清單》并簽字蓋章。五、合同內(nèi)的空格部分可由租賃雙方根據(jù)實(shí)際情況約定填寫(xiě)。六、本合同簽訂之日起30日內(nèi)租賃雙方應(yīng)按規(guī)定到房屋所在地的區(qū)縣國(guó)土資源和房屋管理局或其委托的機(jī)構(gòu)辦理房屋租賃合同登記備案手續(xù)。
北京市房地產(chǎn)經(jīng)紀(jì)合同
依據(jù)國(guó)家有關(guān)法律、法規(guī)和本市有關(guān)規(guī)定，甲、乙雙方在平等、自愿和協(xié)商一致的基礎(chǔ)上，就甲方委托乙方，乙方接受甲方委托從事房地產(chǎn)經(jīng)紀(jì)事項(xiàng)達(dá)成一致，訂立本合同。第一條 甲乙雙方應(yīng)提供下列相應(yīng)證件：甲方提供：1.“銷售許可證”；2.權(quán)屬證件；3.物業(yè)的具體情況；4.法定代表人身份證明；5.營(yíng)業(yè)執(zhí)照；6.個(gè)人身份證。乙方提供：1.經(jīng)紀(jì)機(jī)構(gòu)“資質(zhì)證書(shū)”；2.經(jīng)紀(jì)人崗位“資格證”；3.經(jīng)紀(jì)人身份證；4.營(yíng)業(yè)執(zhí)照。第二條 甲方委托乙方據(jù)實(shí)為其提供房地產(chǎn)經(jīng)紀(jì)服務(wù)。共 項(xiàng)：1. 房地產(chǎn)經(jīng)紀(jì)事項(xiàng)內(nèi)容： 。2.具體要求： 。3.其他要求： 。第三條 甲、乙雙方議定，在本合同履行期限內(nèi)，甲方對(duì)其委托各房地產(chǎn)經(jīng)紀(jì)事項(xiàng)，應(yīng)在規(guī)定范圍之內(nèi)按下列比率向乙方支付服務(wù)費(fèi)。委托代理房地產(chǎn)轉(zhuǎn)讓，按成交價(jià)的 ％計(jì)算支付；

第四條 本合同履行期間，除甲方原因，乙方不能履行本合同第二條服務(wù)事項(xiàng)的，甲方不支付本合同第三條約定的各項(xiàng)服務(wù)費(fèi)。乙方應(yīng)將甲方已預(yù)付的服務(wù)費(fèi)全部退還。乙方不能完全履行服務(wù)項(xiàng)目，則相應(yīng)減少甲方應(yīng)支付的服務(wù)費(fèi)。具體數(shù)額甲、乙雙方在補(bǔ)充條款中另行約定。本合同生效后，在合同履行期間甲方未經(jīng)乙方同意，中途毀約，甲方已支付給乙方的服務(wù)費(fèi)不予退還。未支付給乙方服務(wù)費(fèi)，乙方有權(quán)按雙方約定服務(wù)費(fèi)的標(biāo)準(zhǔn)，向甲方追索。第五條 本合同履行期間，甲、乙任何一方需變更本合同的，要求變更一方應(yīng)及時(shí)書(shū)面通知對(duì)方，征得對(duì)方同意后，雙方在規(guī)定的時(shí)限內(nèi)（書(shū)面通知發(fā)出＿天內(nèi)）簽訂變更協(xié)議，否則，由此造成對(duì)方的經(jīng)濟(jì)損失，由責(zé)任方承擔(dān)。第六條 本合同履行期間，乙方應(yīng)定期將本合同第二條為甲方服務(wù)的各房地產(chǎn)經(jīng)紀(jì)事項(xiàng)情況及時(shí)通告甲方，甲方對(duì)乙方的履約應(yīng)提供必要的幫助。并有權(quán)隨時(shí)進(jìn)行查詢、督促。乙方將本合同第二條為甲方服務(wù)的各房地產(chǎn)經(jīng)紀(jì)事項(xiàng)轉(zhuǎn)委托其他房地產(chǎn)經(jīng)紀(jì)人的，必須事先征得甲方的書(shū)面同意，由此而增加的費(fèi)用和法律責(zé)任，由乙方承擔(dān)。第七條 甲、乙雙方商定，乙方有下列情況之一的，甲方有權(quán)按本合同第十三條約定，追償因乙方過(guò)失造成的經(jīng)濟(jì)損失：1.未經(jīng)甲方書(shū)面同意，擅自改變?yōu)榧追椒?wù)的各房地產(chǎn)經(jīng)紀(jì)事項(xiàng)內(nèi)容、要求和標(biāo)準(zhǔn)的；2.未經(jīng)甲方書(shū)面同意，轉(zhuǎn)委托他人代理的；3.違反國(guó)家和本市有關(guān)法律、法規(guī)、違背誠(chéng)實(shí)信用原則，或與他人惡意串通，損害當(dāng)事人利益的；4. 。第八條 甲、乙雙方商定，甲方有下列情況之一的，乙方有權(quán)按本合同第十三條約定，追償因甲方過(guò)失所造成的經(jīng)濟(jì)損失：1.要求乙方服務(wù)的房地產(chǎn)經(jīng)紀(jì)事項(xiàng)不明確，或提供的有關(guān)證件和資料不實(shí)；2.甲方利用乙方提供的信息、條件、機(jī)會(huì)，擅自不履行合同；3.違反本合同第三條及補(bǔ)充條款的約定，不按期給付或拒付服務(wù)費(fèi)的；4. 。第九條 甲、乙雙方商定，乙方履行本合同第二條各房地產(chǎn)經(jīng)紀(jì)事項(xiàng)的服務(wù)，必須自本合同生效之日起至 年 月 日止。除甲乙雙方另有約定同意延期外，逾期視作本合同自行終止。在本合同終止后的＿＿日內(nèi)，如果委托人直接或間接地與經(jīng)紀(jì)人最初物色的客戶成交，那么經(jīng)紀(jì)人有權(quán)獲得經(jīng)紀(jì)合同中訂立的傭金。第十條 本合同履行期間，甲、乙雙方因履行本合同而簽署的補(bǔ)充協(xié)議及其它書(shū)面的文件，均為本合同不可分割的部分，具有同等法律效力。第十一條 本合同及補(bǔ)充條款中未約定的事項(xiàng)，應(yīng)遵循我國(guó)有關(guān)法律、法規(guī)和本市規(guī)定執(zhí)行。
